Terms and Conditions
Please
read all terms and conditions before booking.
Important:
Your
booking for these vacations involves an agreement between you and
various service providers. Neither USA CUBA TRAVEL nor the Tour Operator
owns, manages, controls or operates any transportation vehicle, hotel,
resort, cruise ship, restaurant or other service supplier and neither of
the aforementioned parties is responsible for the acts or omissions of
such suppliers.
How
To Make A Booking:
Bookings
are confirmed on a first-come, first-served basis. Early reservations are
recommended. Call or write USA CUBA TRAVEL and we will send you a passenger
and credit-card form. Upon reception of payment and of the form signed
by the customer, USA CUBA TRAVEL will contact the Tour Operator or another
service provider for reservations. Bookings will only be confirmed if payments
are received in accordance with the payments section.
Payments:
Bookings
made between 45 days before departure and departure – full payment
is due immediately, or
Bookings
made more than 45 days before departure – a non-refundable deposit
plus applicable insurance and/or bond premiums are due immediately, and
the balance (“final payment”) is due no fewer than 45 days prior to departure.

deposit amounts per person:

Accommodations:

Coach
tours, driving tours, walking and cycling tours: $100
Domestic
flights: $100
Car
rentals: $50
USA
CUBA TRAVEL or the Tour Operator reserves the right to cancel a booking
where if payment is not received within 5 days of its due date.
Acceptable
forms of payment: Credit card, money order, wire transfer.
Credit
Cards: When using a credit card to confirm or pay for a booking, the
passenger or the cardholder allows USA CUBA TRAVEL to use the card for
the agreed-upon purpose.
Cancellations:
If
you intend to cancel, notify USA CUBA TRAVEL immediately. Cancellation
charges will be calculated from the date the Tour Operator receives notice
of cancellation.
Cancellation
charges*:

days or more prior to departure: Full deposit
30
days to 15 days prior to departure: 50% of total price**
14
days prior to, on or after the departure date: 100% of total price**
*
The cancellation charge is a liquidated damage to compensate USA CUBA TRAVEL
or the Tour Operator for prepayments made on advance bookings of travel
services and for administrative costs incurred in processing a cancellation
and is a genuine estimate thereof, not a penalty.

Total price is all money due and/or paid to USA CUBA TRAVEL or the Tour
Operator.
Changes
to a Booking:
A
passenger wishing to change a booking must notify USA CUBA TRAVEL more
than 45 days before the date of departure. An administration charge of
$50 per booking will be applied.
Changes
and/or corrections will not be accepted within 45 days of departure or
after departure.
Special
Requests:
Special
requests, for example concerning room locations, adjoining rooms, bed preferences,
in-flight meal requirements, in-flight seating requirements, sky cots,
on-ship dining requirements, etc., cannot be guaranteed by USA CUBA TRAVEL
or the Tour Operator. While USA CUBA TRAVEL and the Tour Operator will
attempt to accommodate such special requests, neither USA CUBA TRAVEL nor
the Tour Operator can be held responsible if such special requests remain
unsatisfied.
Children:
Unless
otherwise stated, children's prices are restricted to children between
2 and 12 years of age at the time of departure, sharing a room with 2 passengers
paying the full price. Parents will pay for infant tourist cards
in Cuba.
Customs
and Immigration:
Customs
and/or immigration officials can, at their own discretion, deny the passenger
entry into their country. A criminal record could be an obstacle in international
travel, leading to a denial of entry. Neither USA CUBA TRAVEL nor
the Tour Operator can be held responsible for a denial of entry under any
circumstances, and refunds will not be provided.
Documentation:
It
is the passenger's responsibility to obtain, at his or her own expense,
all documentation required by all relevant government authorities.
It is suggested that prior to departure, the passenger learn which documentation
is required. In the event that the passenger does not possess the
documentation required by the destination or the carrier, the carrier reserves
the right to refuse passage and neither USA CUBA TRAVEL nor the Tour Operator
will provide a refund in this instance.
Tickets:
1)
Tickets are available at the airport prior to departure. For bookings
that include hotel accomodations and/or other arrangements, a voucher is
provided prior to departure and is required in order for you to receive
the services booked.
2)
All tickets are valid only for the flight purchased and cannot
be exchanged for other flights.
3)
A charge of $25 will be applied for the re-issue of any ticket documentation.
Flights
and Carriers:
All
flight times, flight itineraries and carriers are subject to change, with
or without prior notice. We recommend that you contact the airline within
24 hours of departure to confirm your departure time. Flight check-in
facilities open three hours and close 45 minutes prior to departure.
The Tour Operator recommends that you check-in 2 to 3 hours prior to
departure. Neither USA CUBA TRAVEL nor the Tour Operator can be held
responsible if you miss your flight or are not allowed to board. Carriage,
services performed and tickets issued by the air carrier are subject to
rules related to liability under the Warsaw Convention and the terms and
conditions stipulated therein. Both USA CUBA TRAVEL and the Tour Operator
make arrangements with several airlines.
Connecting
Flights:
Passengers
connecting with the Tour Operator's flights are advised to allow ample
time between flights. If you are coming directly from another country
to take your flight, you must have sufficient time to clear immigration,
pick up your luggage, change terminals, register your luggage and sign
in. For those operating according to a tight schedule, an overnight
stay is recommended. Neither USA CUBA TRAVEL nor the Tour Operator
can accept any responsibility for additional charges incurred for air fares
or other expenses resulting from irregular airline operations which lead
to changes to flight times and/or subsequent misconnections.
It is recommended that all clients take out travel insurance.
The
Tour Operator's Representative and Troubleshooting:
You
will be met upon your arrival at the destination by the Tour Operator's
representative. If you have any queries or problems, please contact your
representative and/or the hotel. Please address your complaints to the
hotel and/or the Tour Operator's representative or directly to USA CUBA
TRAVEL. Do not wait until you return home.
Accommodations
and Services:
Neither
USA CUBA TRAVEL nor the Tour Operator can be held responsible if some of
the services, bonus features or facilities described on this site cease
to be available, are not operating or fail for any reason. Hotels may remove
or alter some facilities without notice, usually for purposes of ongoing
maintenance and improvement. Use of recreation equipment and facilities,
which may be included in your holiday package, is subject to their being
available at the time of your visit. All hotel rooms offered by USA
CUBA TRAVEL or the Tour Operator are contracted on a "run-of-the-house"
basis. No guarantees can be provided with regard to specific requirements
concerning room or cabin location and other special requests, and in most
cases, the satisfaction of special requests cannot be confirmed prior to
departure. The Tour Operator reserves the right to restrict the number
of single, double, triple, quad and child bookings it will accept at any
particular facility.
Baggage:
Each
person is entitled to one suitcase and one small item of hand luggage.
Weight restrictions are 20 kilos per suitcase. UNLESS INSURED, ALL BAGGAGE
IS CARRIED OR TRANSPORTED AT THE OWNER'S RISK THROUGHOUT THE ENTIRE TRIP.
Refunds:
NO
REFUNDS OR ADJUSTMENTS WILL BE MADE FOR SEGMENTS OF THE TRIP OR ATTENDANT
SERVICES NOT TAKEN OR USED.
Air
Only:
These
are advanced-booking charter flights operated pursuant to the rules of
their country of origin. Payment and cancellation details for ABC
flights are the same as those outlined in How to Book and Cancellation
Charges.
Prices:
All
prices, unless otherwise, stated are per person fares based on two adults
sharing a hotel room or a cruise cabin. All prices advertised on this site
are quoted in American dollars. Prices include transportation taxes and/or
fees. Prices do not include the airport departure tax or any other
exit tax.
Special-Needs
Passengers:
The
Tour Operator cannot guarantee that airports, coaches, transfer vehicles
and accommodations will be wheelchair accessible. Services required for
passengers with special needs are not included in the package price and
may not be available.
Increase
in Costs:
The
prices advertised on this site are based on fixed costs at the time of
their publication. Prices are dependent on fuel costs, rates of exchange
and other factors. Should these costs increase, USA CUBA TRAVEL and the
Tour Operator reserve the right to increase the price of services being
offered. Should the price increase be greater than 7%, the consumer
has the right to cancel the contract for the travel service and obtain
a full refund of all amounts paid to USA CUBA TRAVEL or the Tour Operator,
unless the price increase is the result of government taxation or a fuel
surcharge approved by a transportation agency. Every effort will be made
to advise customer of any price increase at least 15 days prior to their
holiday departure date.
Compliance:
The
passenger agrees to comply with any reasonable instructions issued by USA
CUBA TRAVEL or the Tour Operator or its representative in relation to the
tour. The passenger waives any claim against USA CUBA TRAVEL and the Tour
Operator for loss, damages or injury incurred for any reason as a
result of the providing of any of the services offered on this site.
Interpretation
of the Contract:
This
contract, regardless of where it is applied, shall be interpreted in accordance
with the laws of the province of New Brunswick, and of Canada, and in accordance
with the international conventions and agreements contained herein. Notice:
No agent or representative of USA CUBA TRAVEL has the authority to modify
or waive any provisions of these terms and conditions.
Severability:
The
invalidity of any provision contained herein shall not affect the validity
of any other provision.
Acknowledgment:
The
passenger hereby acknowledges having read these terms and conditions.
Claims:
The
passenger agrees that any claim field against USA CUBA TRAVEL or the Tour
Operator shall be made by the passenger in writing and received by USA
CUBA TRAVEL and the Tour Operator no later than 30 days after the event
causing the claim. Claims or demands made more than 30 days after
the event in question will not be acknowledged or considered. Claims
must be in writing and sent by registered mail to the address of USA CUBA
TRAVEL and/or the Tour Operator prior to the initiation of any legal proceeding
and under no circumstances shall anyone claim from USA CUBA TRAVEL or the
Tour Operator any amount in excess of the actual costs of their vacation.
Cancellation
of Services:
In
the event that certain services are cancelled, USA CUBA TRAVEL and the
Tour Operator will have no responsibility beyond an obligation to refund
all monies received by USA CUBA TRAVEL and the Tour Operator. Such
a refund will be deemed to constitute full settlement.
Responsibilities
of USA CUBA TRAVEL and the Tour Operator:
USA
CUBA TRAVEL and/or the Tour Operator make arrangements with airlines, coach
companies, transfer operators, shore-excursion operators, hotels and other
independent parties to provide you with the travel services and other services
you purchase. Although USA CUBA TRAVEL and the Tour Operator take
reasonable care in selecting these suppliers, neither USA CUBA TRAVEL nor
the Tour Operator has any control over them and therefore cannot be responsible
for their acts or omissions. Services provided are subject to the laws
of the province of New Brunswick, and of Canada, and to any other act or
regulations thereunder applied to the Tour Operator by local authorities
and are subject to the conditions imposed by suppliers, and their liability
is limited by their tariffs, conditions of carriage, tickets and vouchers,
as well as by international conventions and agreements (i.e.; The Warsaw
Convention, The Athens Convention & The London Convention).
Neither
USA CUBA TRAVEL nor the Tour Operator shall be responsible for any loss,
damages or injury, whether physical or psychological, resulting from any
delay, substitution of equipment, or any act, omission, negligence or commission
of any party supplying any of the services or accommodations described
herein, these suppliers including its agents, servants, employees, and
subcontractors, or for any claims for loss, damages, or injury, whether
physical or psychological, arising therefrom, or from any cause that arises
by reason of actions of parties other than USA CUBA TRAVEL or the Tour
Operator. USA CUBA TRAVEL and the Tour Operator reserve the right to deny
any passenger the right to be or remain a member of these tours at any
time.
Government
Approval:
All-Inclusive
tour-charter holidays and ABC flights are operated pursuant to the rules
and regulations applied by local authorities and have been approved by
theses agencies on behalf of USA CUBA TRAVEL and the Tour Operator.
Tour
Operator defined:
Any
tour operator located in Canada or abroad for whom part or all of a package
is puchased upon the customer’s request, USA CUBA TRAVEL will provide full
details concerning any such tour operator.
USA
CUBA TRAVEL defined:
A
duly registered business under the laws of Canada and of the province of
New Brunswick.

Miscellaneous:
The
information appearing on this site supersedes all previously published
information.
Notice
to Travellers:
Travellers
should be aware that different living standards and practices may exist
outside of Canada, including but not limited to, provision of utilities
(i.e. water and electricity), accommodations, services of all kinds, food
preparation, and water quality. Neither USA CUBA TRAVEL nor the Tour
Operator shall be responsible for any loss, damages, injury or inconvenience
resulting from different living standards and practices that are encountered
outside of Canada. All hotels undergo routine maintenance and renovation.
Certain resort areas are undergoing major growth, including considerable
ongoing construction.
